探偵業法第8条に基づく重要事項説明 Explanatory note of important matters based on Section 8 of the Private Detective Regulation Act.

２、探偵業に係る調査の内容、及び、方法 INVESTIGATION MATTERS AND METHODS
(1)調査の内容については、調査委任契約書に記載致します。Investigation matters shall be described in the Investigation Agreement.
(2)調査期間については、契約締結時に定めます。但し、諸事情により変更する場合は、委任者と業者間において十分な協議検討を行った上で再度定めることができるものとします。TAT (Turn around time) shall be decided when in the contract and by agreement between CLIENT and AGENCY. However, in the case of contingency-based cases, the TAT can be changed after sufficient mutual discussion between CLIENT and AGENCY.
(3)調査方法については、調査委任契約書の調査指定事項並びに特記事項に記載致します。Investigation methods shall be described in designated matters and notices of the Investigation Agreement.
３、調査結果報告の方法及び期限 METHOD AND DELIVERY TIME OF INVESTIGATION REPORT

４、調査料金に関して INVESTIGATION FEE
当社規定による調査料金表に基づき概算額と支払期限を下記の通り定めます。（別途の調査料金表参照）※消費税含むBased on our investigation pricing rates, the estimated (approximate) fee and due date of payment shall be stated as follows. (Please refer to the separate investigation fee rates chart.) Consumption tax is included.

５、調査関係書類の処分期限 DEADLINE FOR DISPOSAL OF DOCUMENTS REGARDING INVESTIGATION

６、秘密の保持 CONDFIDENTIALITY
ご依頼に係る委任事項及び業務上知りえた全ての内容については守秘義務を厳守し、第三者に漏洩しないことを誓約致します。また、従業することがなくなった場合も同様とし、業務委任に関係する資料の不正使用を防止するため破棄を含む必要な措置を講ずることを誓約致します。 AGENCY must observe confidentiality regarding all the information obtained in the course of assignment and services, and pledges not to disseminate information to any third parties. Furthermore, AGENCY must observe confidentiality even if AGENCY goes out of business. Also, AGENCY must take all necessary measures, including the disposal of documents, to prevent abuse of CLIENT’s information concerning the investigation assignment.
７、個人情報の取り扱いについて PRIVACY POLYCY
(1)「個人情報の保護に関する法律」及び関係法令を遵守し、個人情報については、ご依頼の委任事項について業務を遂行し調査結果を報告する目的及び、ご依頼事項に係る相談並びに各種提供サービス業務についてと個別にご了承頂いた目的以外には使用致しません。AGENCY pledges to comply with the Act on the Protection of Personal Information and relevant laws, and shall not use personal information except for the purposes of consultations, investigative services and the said matters acknowledged individually in the assignment.
(2)ご依頼に係る個人情報については、法令に基づく正当な要求である場合を除き、ご依頼者の同意なく第三者に提供することはありません。 All investigative findings furnished to CLIENT are exclusively for CLIENT’s own use. CLIENT agrees to restrict the dissemination of said findings ONLY to third parties who have a legitimate need to know and as authorized by law.
８、調査料金の支払時期と方法 INVESTIGATION FEE PAYMENT PERIOD AND METHOD
(1)お支払時期は、契約締結時に調査料金（概算額）の全納が基本となります。 In principle, the full investigation fee amount (estimated approximate amount) shall be paid upon contractual agreement between CLIENT and AGENCY.
(2)分割による支払、及び、実費経費の支払時期、成功報酬金額の支払時期等については、委任者と当社間において十分な協議検討を行った上で合意した支払期日を調査委任契約書に記載することと致します。 For payment by installments, and payment date of expenses, contingency fee, etc., AGENCY will fill in the payment date in the Investigation Agreement, as agreed upon by mutual consultation between CLIENT and AGENCY.
(3)分割支払として契約した場合、残金の支払時期は報告書提出時にご請求致します。 When contracted for payment by installments, the balance shall be billed on delivery of the report.
(4)調査料金のお支払いは現金、若しくは、合意のもとに小切手、手形及び信販会社の利用による支も可能と致します。
信販会社を利用した場合は、別途信販会社とのご契約によるお支払方法となります。 Payment shall be made in cash, or, upon mutual agreement, may also be made by check, draft, or via use of a lending institution. If a lending institution is used, the payment method shall be as specified by a separate contract with that institution.
９、契約の解除に関する事項 CANCELLATION POLICY
(1)業務遂行中、委任者における対象者の個人情報の利用目的（調査利用目的）が、下記に掲げる場合に該当した場合、契約の解除とさせて頂きます。又、この場合、調査料金等は全額お支払して頂くと共に、損害賠償等の法的措置を講じる場合もございますのでご了承ください。Assignment shall be cancelled if, during the investigation, the purpose of use of the investigation (purpose for use of the subject’s personal information) is found to correspond to any of the following purposes. In this case, CLIENT must pay investigation fee in full and understands that AGENCY may take legal action to claim damages from CLIENT. Assignment shall be cancelled when investigative results are used or are intended to be used:
a) 調査結果を、犯罪目的、及び、社会的差別に利用することが判明した場合。For criminal, or discriminatory purposes.
b) ストーカー行為の規制に関する法律題2条の「つきまとい等」目的、その他違法行為に利用することが判明した場合。For the purpose of stalking as defined in the Anti-Stalking Act Section 2, or any other illegal act.
c) 配偶者からの暴力の防止及び被害者の保護に関する法律第１条第２項の被害者の所在の調査の目的、その他違法である場合。For location of a victim as defined in the Act on the Prevention of Spousal Violence and the Protection of Victims Section 1 Article 2, or other illegal purposes.
d) 盗聴、盗撮行為目的、その他違法である場合。For wiretapping, peeping filming or other illegal purposes.
e) その他公序良俗に反する場合。For any other purpose which could violate public order or morals.
(2)委任者から契約の解除、又は、中止の要請があった場合は調査委任契約書に記載されている解約手数料を申し受けます。又、調査着手指示が無いまま３ヶ月間を経過した場合は、調査が終了したものとみなし、料金の返還は致しません。Cancellation fees shall be applied when CLIENT issues a request for cancellation or discontinuation. Furthermore, if the CLIENT’s instruction to commence investigation is not received within the period of three months after assignment, the investigation is deemed terminated and investigation fees are non-refundable.
(3) 当社の事情や業務の推移状況等により、以後の業務を中止する場合は下記の通りとします。 The following policies shall be applied when investigation is discontinued due to AGENCY’s circumstances or state of progress.
a) 中止事由が当社側の責任による場合で、なお且つ、調査着手前である場合、料金の全額を返還致します。
Full refund of investigation fee will be made if the investigation is yet to have commenced and the reason for discontinuation is attributed to AGENCY’s circumstances.
b) 公益上の問題、或いは、天変地異等の理由で調査を中断せざるを得ない場合、中止までの調査料金を当社既定により精算し、残金を返還致します。 AGENCY will refund the balance of investigation fee from the date of assignment up until discontinuation, as calculated by AGENCY’s standard pricing rate, should discontinuation of investigation become inevitable due to reasons such as, but not limited to, public unrest or acts of nature.
c) 行動確認調査において、推移状況（交通情勢・地理的状況等）、対象者の警戒・違反運転により、やむを得ず中止した場合の調査料金は、調査員配置時刻を起算とて次の通りと致します。 基本料金＋（使用単価×稼動時間）＋調査実費 During surveillance, if the investigation is discontinued because of compelling reasons such as public unrest or unavoidable or unforeseen events (traffic, geographical situation, etc.), the subject being alerted to investigation or the subject driving recklessly, the following rate is applied based on the deployment time of investigators. Basic Rate + (Hourly Cost × Deployment Hours) + Investigation Expenses
d) 所在調査（家出人捜索を含む）に関しては、調査期間中の調査活動に関係なく対象者の所在が判明した場合は調査終了とみなし、日数の如何を問わず料金の返還はできません。 For “location/locating” investigations (including runaway searches), in the case that the subject is located during the investigation period by means other than the investigation, the investigation shall be considered terminated and no refund shall be given regardless of the number of days that have passed since the case began.
10、提供することができる探偵業務の内容 DETAILS OF AVAILABLE INVESTIGATIVE SERVICES
本委任契約により収集できる情報、実施できる調査方法、調査体制、調査を実施できる地域の範囲を明確にし、ご依頼に係る特定人の所在又は行動についての情報を、面接による聞き込み、尾行、張り込みその他これらに類似する方法を以ってその調査結果を報告する業務。This Investigation Agreement shall specify the type of information that can be gathered, methods of investigation that can be used, investigation systems, and the geographical region(s) in which the investigation can be carried out. Private detective service is defined as the service to investigate and report information such as the whereabouts or activities of the specified subject in the assignment, using methods such as inquiry, tailing, surveillance or methods similar to those.
11、業務の委託について USE OF SUBCONTRACTORS
委任を受けた調査業務を遂行するために、その業務が実施される地域等にかかわりなく、提示した探偵業務委任提携業者に業務の全部、又は、一部を委任する場合があります。その場合は適切な監督を行うとともに、ご依頼者に提供していただいた個人情報、及び、業務上知り得た全ての情報について安全管理措置を講じます。AGENCY may entrust associate subcontractors to complete the whole assignment or for partial assignment, regardless of the location in which the investigation is to be conducted. In this case, AGENCY will carry out appropriate supervision, and take safety measures on all personal information provided by the client and all information obtained in the course of the investigation.
12、委任業務によって作成、又は、取得した資料の処分 DISPOSAL OF INFORMATION AND FINDINGS FURNISHED FOR CLIENT
調査結果（対象者の個人情報）を委任者に報告（利用目的を達成）した場合、速やかに対象者の個人情報を破棄致します。
但し、委任者と当社間において十分な協議を行った上で、第5項で記載した保存期間のみ保管できることとし、保存期間終了後はシュレッダー等を用いて速やかに破棄処分致します。 AGENCY will promptly dispose of personal information when investigative results (subject’s personal information) are reported to CLIENT (investigative purpose is fulfilled). However, AGENCY can retain information for the period defined in Section 5 upon adequate consultation with CLIENT and shall promptly dispose of all information through use of means of devices such as paper shredders or related equipment after the retention period is over.
