５、業務の委託について Use of subcontract
委任を受けた調査業務を遂行するために、その業務が実施される地域等にかかわりなく、提示した探偵業務委任提携業者に業務の全部、又は、一部を委任する場合があります。その場合は適切な監督を行うとともに、ご依頼者に提供していただいた個人情報、及び、業務上知り得た全ての情報について安全管理措置を講じます。AGENCY may entrust associate subcontractors to complete the whole assignment or for partial assignment, regardless of the location in which the investigation is to be conducted. In this case, AGENCY will carry out appropriate supervision, and take safety measures on all personal information provided by the client and all information obtained in the course of the investigation.
６、概算料金、支払い時期・方法 Total fee (aprox.) / Payment time and method

７、キャンセル規定 Cancellation Policy
1) 行動調査 Surveillance
開始24H内：予約時間料金の80%／開始48H内：予約時間料金の50%／開始72H内：予約時間料金の20％ Within 24 hrs from commencement: 80% of reserved rates, Within 48 hrs from commencement: 50% of reserved rates, Within 72 hrs from commencement: 20% of reserved rates,
2) 行動調査以外（データ確認調査・内偵調査等） Other than surveillance (Data search, inquiries/interviews)
当社規定の調査期間内キャンセル不可。ただし、期間を大幅に超過しても結果判明しない場合、依頼者側からのキャンセルに応じます。 No cancellation is available within the said investigation period. However AGENCY will accept the cancellation from CLIENT if no result is obtained even well after the said period.
８、調査関係資料の処分期限 Deadline for disposal of documents regarding investigation
調査完了後後1年間 One year after the completion of investigation

契約条項 Agreement Clause
１、本契約は委任者が受任者より重要事項の説明がなされた後､本契約書に署名若しくは捺印した時点をもって締結したものと致します｡ This agreement shall be considered binding when the client (hereinafter called “CLIENT”) signs or stamps this agreement after the Explanation of Important Matters is made by the agency (hereinafter called “AGENCY”).
２、本契約の締結と同時に｢探偵業の業務の適正化に関する法律｣に拠って規定される重要事項説明を受けたことを確認するために重要事項説明書に署名･捺印して提出して頂きます。CLIENT shall complete this agreement as well as sign and submit a copy of the Explanation of Important Matters to confirm having been made aware of the Explanation of Important Matters.
３，本契約書並びに重要事項説明書その他関連書面は､複写を以って委任者と受任者双方にて保管できるものとします｡Both CLIENT and AGENCY can save a copy of this agreement, the Explanation of Important Matters and related documents as hard copies or in digital format. (但し､申込者の意向でその一通を手元に保管出来ない理由が有る場合は調査完了迄の間､当方にてお預かりする事が有ります｡又､申込み者の事情による電話契約の場合にその一通が申込み者に郵送出来ない事情がある場合も同様とします｡) However, if CLIENT is unable to retain a set of documents by his/her side, AGENCY will retain the documents until the completion of the investigation services. And the same applies to cases where CLIENT assigns AGENCY over the phone and AGENY is unable to send a set of documents to CLIENT (e.g., It is imprudent for the client to retain documents for privacy or safety reasons.).
４、契約締結後に委任者から契約の解除(着手前･着手後)の申出があった場合、又は､調査中止の要請があった場合､調査料金の総額(調査料及び調査実費等の総合計金額)に対する解約手数料として､表面記載の違約金を申し受けます。但し､委任者の事情で､調査着手指示がないまま3ケ月を経過した場合､調査を終了したものとみなし料金の返還はできません｡尚､調査方法等に係る企画会議(調査員の確保及び日程の調整､調査機器･車両の準備等)､事前の現地確認等の予備調査並びに､調査行為としての待機等を実施した場合はすべて着手後とさせて頂きます｡ Cancellation fees detailed in the Agreement shall be applied as exit fees over and above the total amount of the investigation fee (sum of retainer fee and expenses) when CLIENT issues a request for cancellation (before or after the investigation begins) or discontinuation. Furthermore, if the CLIENT’s instruction to commence the investigation is not received within the period of three months (90 days) after assignment, the investigation is deemed terminated and the investigation fee is non-refundable. The investigation is considered to have commenced on the day CLIENT and AGENCY meet (whether in person, on phone or via other communication methods) regarding the investigation methods (reservation of investigators, adjustment of dates, preparation of investigation devices and vehicles, etc.), preliminary reconnaissance and stand-by as a part of the investigation.
５、契約締結後に､当社の事情や調査の推移状況等により以後の調査を中止する場合があります｡ Investigation may be discontinued due to AGENCY’s circumstances or unforeseen or unavoidable events.
1) 着手前及び中止事由が当社側の事情による場合は､料金の全額を返還します。A full refund of the investigation fee will be made if the investigation is yet to have commenced and the reason for discontinuation is attributed to AGENCY’s circumstances.
2) 中止事由が公益上或いは天変地異等､止むを得ない事情による場合は､中止までの料金を当社規定により清算し残金を返還致します｡ AGENCY will refund the balance of investigation fee from the date of commencement up until the date of the discontinuation, as calculated by AGENCY’s standard pricing rate, should discontinuation of investigation become inevitable due to reasons such as, but not limited to, public unrest, strikes, power outages, acts of nature or other events for which AGENCY is not responsible and that are unforeseeable and/or unavoidable.
3) 行動確認調査において調査の推移状況(交過情勢･地理的状況等)､対象者の警戒･違反運転により､止むを得ず中止した場合は､調査員配置時刻を起算時として次の通りとします｡ 基本調査料金+ (時間単価×稼働時間)+調査実費 During surveillance, if the investigation is discontinued because of compelling reasons such as public unrest or acts or nature (traffic, geographical situation, etc.), the subject being made aware of the investigation or the subject driving recklessly, the following rate is applied based on the deployment time of investigators. Basic Rate + (Hourly Cost × Deployment Hours) + Investigation Expenses
4) 所在調査において､調査期間中の調査活動に関係なく被調査人の所在が判明した場合は､速やかに連絡をして頂き､またそれに伴い調査終了とみなされ､調査委任契約書にある特記事項に従い清算いたします｡ For “location/locating” investigations, in cases in which the subject is located regardless of the investigative activities during the investigation period, CLIENT shall report it to the AGENCY immediately and the investigation shall be considered to be terminated and account adjustments shall be made according to the conditions depicted in the notes of Agreement.
5) 委任者から契約の解除、又は、中止の要請があった場合は調査委任契約書に記載されている解約手数料を申し受けます。又、調査着手指示が無いまま３ヶ月間を経過した場合は、調査が終了したものとみなし、料金の返還は致しません。Cancellation fees shall be applied when CLIENT issues a request for cancellation or discontinuation. Furthermore, AGENCY shall not refund the retainer fee if CLIENT fails to instruct when to commence the investigation within three months after assignment. After three months, the investigation is deemed terminated and fees are not refundable.
６、業務遂行中､委任者における対象者の個人情報利用目的(調査利用目的)が､下記に掲げる場合に該当した場合は契約の解除とさせて頂きます｡又、この場合､調査料金等は全額お支払いして頂くと共に､損害賠償等の法的措置を講じる場合もございますのでご了承下さい｡ The assignment shall be cancelled if, during the investigation, the purpose of the investigation (what CLIENT plans to do with subject’s personal information) comes under any of the following purposes. In this case, CLIENT must pay investigation fees in full and understands that AGENCY may take legal action to claim damages from CLIENT.
1) 調査結果を、犯罪目的、及び、社会的差別に利用することが判明した場合。For criminal, or discriminatory purposes.
2) ストーカー行為の規制に関する法律題2条の「つきまとい等」目的、その他違法行為に利用することが判明した場合。For the purpose of stalking as defined in the Anti-Stalking Act Section 2, or any other illegal act.
3) 配偶者からの暴力の防止及び被害者の保護に関する法律第１条第２項の被害者の所在の調査の目的、その他違法である場合。For location of a victim as defined in the Act on the Prevention of Spousal Violence and the Protection of Victims Section 1 Article 2, or other illegal purposes.
4) 盗聴、盗撮行為目的、その他違法である場合。For wiretapping, peeping filming or other illegal purposes.
5) その他公序良俗に反する場合。For any other purpose which could violate public order or morals.
７、依頼事項及び調査等により知り得た事実関係については､個人情報保護法等を遵守致しますが､委任者におかれましても絶対に口外等はせず秘密を厳守して下さい｡ AGENCY pledges to comply with the Act on the Protection of Personal Information and relevant laws regarding the facts known through the assignment or investigation, and CLIENT shall also retain confidentiality without revealing any secrets.
８、委任者から提出された資料及び情報の過誤が原因で調査目的と異なった結果を生じた場合及び､委任者が当該調査実施に於いて知り得た情報の利用に因る波及効果については､当社は一切その責任を負いません｡ AGENCY shall be immune to any cases where “different investigation results than expected” are obtained from the investigation due to the faults of material or information provided by CLIENT and synergistic effects which arise from the usage of information obtained by CLIENT during the accomplishment of said investigation.
９、本契約に関して法律上の問題が生じた場合､受任者事務所所在地を管轄する裁判所を管轄裁判所とすることに合意します｡ CLIENT agrees that, in the event of any legal problems regarding this Agreement, that the jurisdiction and venue shall be the court governing the location of AGENCY’s office.
